Common use of 2007 Net Income Clause in Contracts

2007 Net Income. As soon as practicable, but in any event within 90 days after the end of the 2007 fiscal year, the Company shall deliver to the Holder (i) an income statement for such fiscal year, a balance sheet and statement of shareholders’ equity as of the end of such year, and a statement of cash flows for such year, such financial reports to be on a consolidated basis for the Company and its subsidiaries, prepared in accordance with United States generally accepted accounting principles (“GAAP”), consistently applied, and audited and certified by independent public accountants of nationally recognized standing selected by the Company and (ii) a certificate of the chief financial officer of the Company setting forth in reasonable detail the calculation of 2007 Net Income. The Holder shall have the right to object to the determination of 2007 Net Income in accordance with paragraph (c) below.
