Ability to Earn Livelihood. Employee further acknowledges that (1) in the event his employment with Employer ceases for any reason, he will be able to earn a livelihood without violating the foregoing restrictions; and (2) that his ability to earn a livelihood without violating such restrictions is a material condition to his employment with Employer.
