Academic Use. 3.1. If Customer is an educational institution acquiring Purchased Services, in deviation to Section 2.1 the following additional terms and restrictions shall apply with respect to the Services: (a) For the purposes of Purchased Services made available for Academic Use, eligible “Users” shall be limited to Customer’s faculty members, staff, and students enrolled in a degree- or certificate-granting program; (b) Customer may use Purchased Services solely for academic use, and not for commercial, professional, or other for-profit purposes; (c) Purchased Services are not to be installed, accessed, used, or operated at or from facilities or locations that are operated for commercial, professional or for-profit purposes; and (d) access and use of Purchased Services is permitted solely from Customer-owned and -controlled computing devices and only for the following permitted academic use: (i) If Purchased Services are acquired for “classroom use” or “teaching use”, solely for authorized classroom projects; and (ii) If Purchased Services are acquired for “academic research”, solely for Customer’s own non-commercial, academic research, where the results of such research are published or public domain. For avoidance of doubt, private or government restricted research projects require purchase of Purchased Services for commercial use. Any Purchased Services acquired by an educational institution are deemed to be acquired for Academic Use (and not commercial use), unless stated or indicated otherwise by Hexagon or its Affiliate in writing. Only qualified educational institutions (as determined by Hexagon or its Affiliate in its sole discretion), are eligible to acquire Purchased Services for Academic Use. Commercial organizations and other non-qualifying entities or persons are not eligible to acquire Purchased Services for Academic Use. 3.2. If Customer is an educational institute and entitled to technical support for Purchased Services acquired for Academic Use, the following additional terms and restrictions shall apply: Customer shall designate in writing a “Designated Contact” (“DC”). The DC shall be a knowledgeable full-time staff representative of Customer and serve as the focal point for administering and resolving all Customer requests for technical support.   • Academic Freedom Academic freedom shall be guaranteed to all employees, and no special limitation shall be placed upon study, investigation, presentation and interpretation of facts and ideas concerning man, human society, the physical and biological world, and other branches of learning subject to accepted standards of professional responsibility, community standards, and District-approved curriculum. These responsibilities include a commitment to democratic tradition, a concern for the welfare, growth and development of children, and an insistence upon objective scholarship.   • Academic Year Academic Year is defined as beginning with the start of fall semester and ending with the completion of spring semester.

  • Research Use The Requester agrees that if access is approved, (1) the PI named in the DAR and (2) those named in the “Senior/Key Person Profile” section of the DAR, including the Information Technology Director and any trainee, employee, or contractor1 working on the proposed research project under the direct oversight of these individuals, shall become Approved Users of the requested dataset(s). Research use will occur solely in connection with the approved research project described in the DAR, which includes a 1-2 paragraph description of the proposed research (i.e., a Research Use Statement). Investigators interested in using Cloud Computing for data storage and analysis must request permission to use Cloud Computing in the DAR and identify the Cloud Service Provider (CSP) or providers and/or Private Cloud System (PCS) that they propose to use. They must also submit a Cloud Computing Use Statement as part of the DAR that describes the type of service and how it will be used to carry out the proposed research as described in the Research Use Statement. If the Approved Users plan to collaborate with investigators outside the Requester, the investigators at each external site must submit an independent DAR using the same project title and Research Use Statement, and if using the cloud, Cloud Computing Use Statement. New uses of these data outside those described in the DAR will require submission of a new DAR; modifications to the research project will require submission of an amendment to this application (e.g., adding or deleting Requester Collaborators from the Requester, adding datasets to an approved project). Access to the requested dataset(s) is granted for a period of one (1) year, with the option to renew access or close-out a project at the end of that year. Submitting Investigator(s), or their collaborators, who provided the data or samples used to generate controlled-access datasets subject to the NIH GDS Policy and who have Institutional Review Board (IRB) approval and who meet any other study specific terms of access, are exempt from the limitation on the scope of the research use as defined in the DAR.

  • PERSONAL AND ACADEMIC FREEDOM A. The personal life of a teacher shall be the concern of and warrant the review and appropriate action of the Board only: 1.
