Common use of Access Rights for Use Clause in Contracts

Access Rights for Use. a) Access Rights to Foreground Needed by a Party for Use of its own Foreground including for Use for third-party research shall be granted on fair and reasonable conditions. b) A third party shall not be granted direct access to Foreground or Sideground generated by other Parties unless those Parties explicitly agree to it. c) Access Rights to Foreground for internal research purposes, excluding research activities involving third parties and excluding activities with a commercial purpose, shall be granted on a royalty-free basis.

Access Rights for Use. a) Access Rights to Foreground if Needed by a Party for Use of its a Party's own Foreground including for Use for third-party research shall be granted on fair and reasonable conditions. b) conditions in a written bilateral agreement. Use for third party research shall be subject to the prior written approval of the owner of the Foreground, such agreement will not be granted direct access to Foreground or Sideground generated by other Parties unless those Parties explicitly agree to it. c) unreasonably withheld. A request for Access Rights may be made up to two (2) years after the end of the -ITD.

Unless required for internal research activities and third party research, access is granted on a royalty-free basis. A third party shall not be granted direct Access to Foreground generated by a Party other Parties unless those parties explicitly agree to it. Access Rights to Background Needed for Use of its a Party’s own Foreground including for Use for third-party research shall be granted on fair and reasonable conditions. b) A third party shall not be granted direct access to Foreground or Sideground generated by other 10.7.1 New Parties unless those Parties explicitly agree to it. c) Access Rights to Foreground for internal research purposes, excluding research activities involving third parties and excluding activities with a commercial purpose, entering the Consortium All Foregrounds developed before the accession of the new Party shall be granted on a royalty-free basisconsidered to be Background with regard to said new Party.

Access Rights for Use. a) 9.4.1 Access Rights to Foreground if Needed by a Party for Use of its a Party's own Foreground including for Use for third-party research shall be granted on fair and reasonable conditions. b) . A third party (including Affiliated Entities) shall not be granted direct access Access Right to Foreground or Sideground generated by other Parties Background of another Party unless those Parties such owning Party explicitly agree agrees to it. c) Access Rights to Foreground for internal research purposes, excluding research activities involving third parties and excluding activities with a commercial purpose, shall be granted on a royalty-free basis.

Access Rights for Use. a) 9.4.1 Access Rights to Foreground if Needed by a Party for Use of its a Party's own Foreground including for Use for third-third- party research shall be granted on fair and reasonable conditions. b) . A third party shall not be granted direct access Access to Foreground or Sideground generated by other Parties unless those Parties explicitly agree to it. c) . Access Rights to Foreground rights for internal research purposes, excluding research activities involving third parties and excluding activities with a commercial purpose, shall be granted on a royalty-free basisbasis unless otherwise agreed in [Attachment 1] or listed in [Attachment 2] as excluded Background.

Access Rights for Use. a) 9.4.1 Access Rights to Foreground if Needed by a Party for Use of its a Party's own Foreground including for Use for third-party research shall be granted on fair and reasonable conditions. b) conditions and upon written agreement between the concerned Parties. A third party shall not be granted direct access Access to Foreground or Sideground generated by other Parties unless those Parties explicitly agree to itit in writing. c) 9.4.2 Access Rights rights to Foreground if Needed for Use of a Party’s own Foreground for non- commercial internal research activities and for internal research purposes, excluding research activities involving third parties and excluding activities with a non commercial purpose, education purposes shall be granted on a royalty-free basis.
