As per Section 9.2.6, the request for Access Rights is to be in writing, the agreement on fair and reasonable conditions normally also, unless both parties don’t want that formality. Access Rights to Results. Access rights, if needed for research, shall be granted under fair and reasonable conditions. Access rights for exploitation of results if needed for implementing the tasks under the EPICENTRE program shall be also granted under fair and reasonable conditions.
Access Rights to Results. Access rights to Results for internal research activities and for teaching activities shall be granted on a royalty-free basis. Access Rights to Results for any other Exploitation shall be granted on Fair and Reasonable Conditions subject to the following:
a. The Party requiring the grant of such Access Rights (the “Requesting Party”) shall make a written request to the Party (the “Granting Party”) from which it requires the Access Rights.
b. The written request shall identify the Results concerned.
c. Any such Access Rights shall only be granted upon the signature of a written agreement between the Granting Party and the Requesting Party and shall not be otherwise deemed granted. Fair and Reasonable Conditions to the potential benefit of the Requesting Party refer to the fact that such Party and the Granting Party have collaborated in the Action to their mutual benefit. Parties of an Action shall be offered conditions ensuring fair compensation and standard transfer agreement terms to the Granting Party.
Access Rights to Results. The BioMan4R2 Beneficiary shall be the exclusive owner of its prior own specific knowledge. Nothing in this Contract can be construed as granting access right to any third party to BioMan4R2 Beneficiary's background.

Access Rights to Results if required by a Party which is an academic institution shall also be granted on a royalty-free basis (a) solely for non-commercial teaching or patient care by that academic institution; and (b) with the academic institution having no right to sub-licence or assign such Access Rights; and (c) subject to the obligations of confidentiality under Article 10 and with such Access Rights terminating automatically in the event that such academic organization is no longer a Beneficiary or Associated Partner to the Consortium.
Access Rights to Results. 9.2.1 For the duration of the Project, each Party shall have access at no charge to Results of other Parties that are necessary for implementing its own work in the Project.
9.2.2 The Parties shall have access at no charge to Results of other Parties for their own research purposes. Subject to the rights of third parties, access rights to Results for non− commercial and non−industrial research activities shall be granted on a royalty−free basis.
9.2.3 Each owner of Joint Results shall be entitled to otherwise exploit these Joint Results and to grant non−exclusive licences to third parties (without any right to sub−license), after signing a separate co−ownership agreement specifying the IP Manager and the terms and conditions for exploitation of Joint Results for industrial and/or commercial purpose. Subject to the rights of third parties, access rights to Results shall be granted on fair and reasonable financial conditions.
9.2.4 Subject to the rights of third parties, access rights of Affiliates to Results shall be granted on fair and reasonable financial conditions and upon written bilateral agreement.
9.2.5 All requests for user rights to Results must be submitted in writing.
