Common use of Access to City Data Clause in Contracts

Access to City Data. 4.5.1 The City shall, to the extent permitted by law, allow Architect/Engineer to access and make copies of documents in the possession or control of the City or available to it that are reasonably necessary for Architect/Engineer to perform under this Contract. 4.5.2 The City does not, however, represent that all existing conditions are fully documented, nor is the City obligated to develop new documentation for Architect/Engineer’s use. 4.5.3 For any raw data created, assembled, used, maintained, collected, or stored by the Architect/Engineer for or on behalf of the City, Architect/Engineer shall provide the City either the raw data itself or the ability to extract the raw data in a format mutually agreed upon by both parties at no additional cost to the City. and it has no other remedy in law or in equity against the City and no right to damages of any kind.
