Common use of Access to Personnel Records Clause in Contracts

Access to Personnel Records. (a) Upon receiving the permission of the Chief Constable or designate, a member may review the contents of their personnel file provided that such review is in the presence of a person authorized for such a purpose by the Chief Constable. (b) A copy of any written material concerning a member's job performance shall be provided to the member as soon as possible after it is recorded in the member's file. Should a member dispute any such entry in the file, that member shall be entitled to recourse through the grievance procedure contained in Section 14 of this Agreement. The Employer agrees not to introduce as evidence in any hearing arising from a job performance grievance any document from the file of a member, the existence of which the member was not aware of at the time of filing.
