Common use of Access to the Facilities Clause in Contracts

Access to the Facilities. (a) You must present your access fob or photo ID to gain entry to the Facilities. Your access fob remains the property of TQ Fitness and you cannot lend your fob or allow anyone else to use it. If you lose your membership fob, a replacement can be purchased for $30 from Reception upon providing proof of identification. (b) Only members are permitted access to the Facilities. You must not bring a non-member into the Facilities. If you breach this obligation, you acknowledge that: (i) you accept responsibility and liability on their personal behalf for any injury, loss or damage attributed to the non-member whether or not caused through the negligence of TQ Fitness; (ii) TQ Fitness may charge you a Tailgate Fee of up to $100 for each occasion where it is reasonably satisfied of your breach of this clause; (iii) TQ Fitness may cancel your membership and access to TQ Fitness.
