Common use of Accounts Stated Clause in Contracts

Accounts Stated. Guarantor shall be bound by any account settled between Borrower and the Guaranteed Parties, and if no such account has been so settled immediately before demand for payment under this Guarantee, any account stated by Agent shall be accepted by Guarantor as prima facie evidence in the absence of manifest error of the amount which at the date of the account so stated is due by Borrower to the Guaranteed Parties or remains unpaid by Borrower to the Guaranteed Parties.
