Acknowledgment of Rights of Other Party to Joint Foreground IP. Subject to the exclusive licenses granted under this ‎Section 6.03(d), each of the Parties acknowledges and agrees that the other Party will be free to fully use, practice, improve, modify and make derivative works of the Joint Foreground IP to the same extent as the other Party, without requiring any approval of (including any approval to license), or any notification, reporting, accounting or payment to, such Party; so long as such Party does not inhibit, conflict or interfere, in any way, with the other Party’s right to freely use and exploit such Joint Foreground IP as joint owner. Each of the Parties acknowledges and agrees that the Joint Foreground IP (other than any patents or published patent applications) shall be deemed to be Confidential Information of both Parties, which shall be treated in accordance with ‎Section 9.08 and subject to the same exceptions in ‎Section 9.08.
