Common use of Actions Pending Resolution of Dispute Clause in Contracts

Actions Pending Resolution of Dispute. Notwithstanding any provisions of this Agreement to the contrary, and even during pending litigation, Health Plan may take all necessary actions, including transfer of Members to another qualified Affiliated Provider if Health Plan, in good faith, believes that Provider's actions endanger Members' health, safety or reasonable access to medical services or expose Health Plan or its Members to unreasonable financial liability.
