Additional Access Rights. [Option 1:] For the avoidance of doubt any grant of Access Rights not covered by the Grant Agreement or this Consortium Agreement shall be at the absolute discretion of the owning Party and subject to such terms and conditions as may be agreed between the owning and receiving Parties. Parties can choose between option 1 and option 2. Option 1 leaves it up the discretion of the Parties whether they grant Access Rights that are not included in the Consortium Agreement, for instance Access Rights to results that are not needed by the requesting Party. In this case, the owning Party is free to refuse such request. Under option 2, the Parties commit themselves to discuss such additional Access Rights in good faith, so they cannot refuse a request at their own discretion without having a reasonable discussion on the request. [Option 2:] The Parties agree to negotiate in good faith any additional Access Rights to Results as might be asked for by any Party, upon adequate financial conditions to be agreed.
