Common use of Additional Compensation Clause in Contracts

Additional Compensation. To the extent not otherwise provided for in this Agreement, in the event that Seller is compensated by a third party for any Product produced by the Project, including, but not limited to, compensation for Resource Adequacy or Green Attributes, Seller shall remit all such compensation directly to Buyer; provided that for avoidance of doubt, nothing herein precludes Seller from retaining credits related to transmission upgrades funded by Seller.

Additional Compensation. To the extent not otherwise provided for in this Agreement, in the event that Seller is compensated by a third party for any Product Products produced by the Project, including, but not limited to, including compensation for Resource Adequacy or Green Attributes, Seller shall remit all such compensation directly to Buyer; provided that for avoidance of doubt, nothing herein precludes Seller from retaining credits related to transmission upgrades funded by SellerElectric System Upgrades contemplated in Section 3.1(h)(i).

Additional Compensation. To the extent not otherwise provided for in this Agreement, and except as provided in Section 3.1(f), in the event that Seller is compensated by a third party party, including the CAISO, for any Product produced by the ProjectProject during the Delivery Term, including, but not limited to, compensation for Energy, Resource Adequacy or Green Attributes, Seller shall remit all such compensation directly to BuyerBuyer via invoice netting; provided that for avoidance of doubt, nothing herein precludes Seller from retaining credits related to transmission upgrades funded by Sellerinterconnection facility upgrades, as applicable.
