Common use of Additional EA Indemnification Obligation Clause in Contracts

Additional EA Indemnification Obligation. EA further agrees to indemnify, defend, and hold Microsoft harmless from any and all claims, demands, costs, liabilities, losses, expenses and damages (including reasonable attorneys' fees, costs, and expert witnesses' fees) arising out of or related to any Claim regarding any Software Title, FPU, DFU or User Generated Content (excluding those portions thereof that consist of components of the Durango XDK in the form(s) as delivered to EA by Microsoft pursuant to a Durango XDK License), including any Claim relating to quality, performance, safety, privacy or security or any Claim arising out of EA’s use of the Licensed Trademarks in breach of this Agreement (but excluding any claims arising out of use of the Licensed Trademarks in accordance with the provisions of this Agreement).
