Penalty Disputes 2 CONTRACTOR may appeal to OCEMS, in writing, within twenty (20) business days of receipt of 3 notification of the imposition of any penalty or penalty calculation. OCEMS shall review all such 4 appeals and make a decision to eliminate, modify, or maintain the appealed penalty. Should the 5 CONTRACTOR desire to appeal the OCEMS decision, a written request must be submitted to the 6 OCEMS Medical Director within ten (10) business days of the occurrence of the event. A 7 CONTRACTOR appeal to the OCEMS Medical Director shall constitute the 8 CONTRACTOR exclusive remedy to challenge the denial of a request for an exception.
