Common use of Additional Premises Term Commencement Date Clause in Contracts

Additional Premises Term Commencement Date. The term with respect to the Additional Premises shall commence on the earlier to occur of the following: (a) occupancy of the Additional Premises by Tenant or (b) three (3) months after the Execution Date (either (a) or (b), the “Additional Premises Term Commencement Date”). Tenant shall execute and deliver to Landlord written acknowledgment of the actual Additional Premises Term Commencement Date and the Amended Term Expiration Date within ten (10) business days after Tenant takes occupancy of the Additional Premises, in substantially the form attached as Exhibit B hereto. Failure to execute and deliver such acknowledgment, however, shall not affect the Additional Premises Term Commencement Date or Landlord’s or Tenant’s liability hereunder. Failure by Tenant to obtain validation by any governmental licensing agency of the Additional Premises required for the Permitted Use by Tenant shall not serve to extend the Additional Premises Term Commencement Date.
