ADDITIONAL PROVISIONS REGARDING PAYMENT OF RENT. All Rent shall be due and payable without any setoff or deduction to Landlord at the times specified in this Article, above. If any installment of Rent is not paid within fifteen (15) days of its due date, Tenant shall pay a late charge to Landlord equal to the greater of $100.00 or five percent (5%) of the overdue payment. Any liability for unpaid Rent shall survive the termination of this Lease. Any and all costs, charges, taxes, premiums, fees or expenses which the Tenant assumes or agrees to pay pursuant to this Lease, including all Operating Expenses, whether pursuant to this Section or elsewhere in this Lease, shall, at the Landlord’s election, be treated as Additional Rent, and in the event of nonpayment thereof, the Landlord shall have the rights and remedies herein provided in the event of nonpayment of Rent or of a breach of a condition or covenant of this Lease. Tenant and Landlord agree that, for all purposes in any way connected with or arising out of this Section 4.03, the statement delivered by Landlord pursuant to this paragraph containing reasonable detail as to Landlord's calculation and the miscellaneous items making up same shall be binding and conclusive on Tenant, unless objected to by Tenant within forty five (45) days after receipt thereof by notice from Tenant specifying Tenant’s objections thereto, provided that Tenant shall, in any case, pay such portions thereof as to which there is no objection. Tenant shall have the right to inspect at reasonable times and upon reasonable advance notice Landlord’s books and records which relate to these items of cost.
