Common use of Additional Quantities Clause in Contracts

Additional Quantities. Should any Purchase Order seek to purchase Product in amounts substantially in excess of the Firm Purchase Commitment, or should RevitaLid desire to increase the amount of Product to be manufactured pursuant to any Purchase Order already submitted, then Nephron shall use commercially reasonable efforts to comply with such requested changes; but Nephron shall not be liable to RevitaLid for any inability, despite its commercially reasonable efforts, to manufacture such excess quantities.
