Common use of Additional Subconsultants Clause in Contracts

Additional Subconsultants. Second-tier and pass-through subconsulting is prohibited. However, in the event that the prime Consultant and its approved subconsultants lack the necessary skills or expertise to perform requested services that are within the scope of the contract, additional subconsultants may be utilized with Port written approval.

Additional Subconsultants. Second-tier and pass-through subconsulting is prohibited. However, in the event that the prime Consultant contractor and its approved subconsultants lack the necessary skills or expertise to perform requested services that are within the scope of the contract, additional subconsultants may be utilized with Port written approval. Second tier subconsulting shall require explicit written Port approval. A mark-up on the subconsultant’s subconsultant is limited to 5% and shall not be subject to further mark-up by the prime consultant.
