Common use of Administration of the Project Clause in Contracts

Administration of the Project. Lenexa will be the Administrator for the Improvements. As Administrator for the Improvements, Lenexa will assume and perform the following duties: A. Coordinate and review the completion of the Improvements. B. Require the Improvements to be completed within conformance with the generally recognized and prevailing standards for completion. C. Require the contractor to comply with all applicable laws and regulations governing construction of the Improvements. D. Solicit bids for and enter into a contract for the making of the Improvements in the manner required by law and require the contractor to comply with all applicable laws and regulations governing public contracts, including all non-discrimination laws and regulations. E. Require statutory and performance bonds for the Improvements from all contractors and require that all contractors discharge and satisfy any mechanics or materialman's liens that may be filed. As Administrator, Lenexa on its own, or at Overland Park’s request, will make any claim upon the statutory and performance bonds and require that the contractor fully perform all obligations under the statutory and performance bonds. F. Require a maintenance bond for the Improvements from all contractors for a two-year period commencing on the date of substantial completion. As Administrator, Lenexa on its own, or at Overland Park’s request, will make any claim upon the maintenance bond and require that the contractor fully perform all obligations under the maintenance bond. G. Require evidence of insurance from the contractor for loss or damage to life or property arising out of the contractor’s negligent acts or omissions in an amount not less than $2,000,000. The Parties shall be named as additional insureds on all applicable certificates of insurance issued by any contractor for the Improvement. H. Require construction contracts to obligate the Contractor to defend, indemnify and save the Parties harmless from and against all liability for damages, costs, and expenses arising out of any claim, suit or action for injuries or damages sustained to persons or property by reason of the acts or omissions of the Contractor and the performance of his or her contract.

Administration of the Project. Lenexa Shawnee will be the Administrator for the Improvements. As Administrator for the Improvements, Lenexa Shawnee will assume and perform the following duties: A. Coordinate and review the completion of design, plan preparation and specifications for the Improvements. The plans and specifications shall be submitted to the Overland Park City Engineer for review and an opportunity to comment prior to advertising for construction bids. The Overland Park City Engineer shall review the plans and specifications for the Improvements, and may, but shall not be obligated to, suggest changes or revisions thereto. B. Require the consulting engineer for the Improvements to be completed within conformance warrant that the design, plans and specifications for the Improvements are in conformity with the generally recognized and prevailing standards for completionof their profession. C. Require the consulting engineer for the Improvements to include Overland Park and Shawnee’s technical specifications in the design, plans and specifications for the Improvements. D. Require the contractor to comply with all applicable laws and regulations governing construction of the Improvements. D. E. Prior to the letting of the contract for construction, submit the plans for approval by the Governing Body of Shawnee. F. Solicit bids for and enter into a contract for the making of the Improvements in the manner required by law and require the contractor to comply with all applicable laws and regulations governing public contracts, including all non-discrimination laws and regulations. E. G. Require statutory statutory, performance and performance completion bonds for the Improvements from all contractors and require that all contractors discharge and satisfy any mechanics or materialman's liens that may be filed. F. H. Require a maintenance bond for the Improvements from all contractors for a two-year period commencing on the date of substantial completion. As Administrator, Lenexa on its ownShawnee will, or at upon request of Overland Park’s request, will make any claim upon the maintenance bond and require that the contractor fully perform all obligations under the maintenance bond. G. I. Require evidence of insurance from the contractor consulting engineers and contractors for loss or damage to life or property arising out of the contractor’s contractors' or engineers' negligent acts or omissions in an amount not less than $2,000,000. The Parties shall be named as additional insureds on all applicable certificates of insurance issued by 2,000,000.00 for any contractor and $1,000,000.00 for the Improvementany engineering consultant. H. Require J. Include in contracts for construction contracts to obligate a requirement that the Contractor to contractor defend, indemnify and save the Parties Shawnee and Overland Park harmless from and against all liability for damages, costs, and expenses arising out of any claim, suit or action for injuries or damages sustained to persons or property by reason of the acts act or omissions of the Contractor contractor and the performance of his or her contract, and requiring Shawnee and Overland Park to be named and endorsed on the policy as an additional insured party in the required liability policy. K. Coordinate all work with utilities, even if some utilities may require relocation in order for the project contractor to complete the Improvements. L. Require the consulting engineers to certify in writing that the Improvements have been completed in accordance with the plans and specifications.
