Common use of Adoption of Procedures Clause in Contracts

Adoption of Procedures. Custodian and Fund may from time to time adopt procedures as they agree upon, and Custodian may conclusively assume that no procedure approved by Fund, or directed by Fund, conflicts with or violates any requirements of its prospectus, "Articles of Incorporation," Bylaws, or any rule or regulation of any regulatory body or governmental agency. Fund will be responsible to notify Custodian of any changes in statutes, regulations, rules or policies which might necessitate changes in Custodian's responsibilities or procedures.

Fund will be responsible to notify Custodian of any changes in statutes, regulations, rules or Fund policies not specifically governing custodians or banks which might necessitate changes in Custodian's responsibilities or procedures.

Fund will be responsible to notify Custodian of any changes in statutes, regulations, rules or policies not specifically governing custodians or banks which might necessitate changes in Custodian's responsibilities or procedures.

Custodian and Fund may from time to time adopt procedures as they agree upon, and Custodian may conclusively assume that no procedure approved by Fund, or directed by Fund, Fund or its accountants or other advisors conflicts with or violates any requirements of its prospectus, "Articles of Incorporation," Trust Agreement, Bylaws, any applicable law, rule or regulation, or any rule order, decree or regulation of any regulatory body or governmental agencyagreement by which Fund may lie bound. Fund will be responsible to notify Custodian of any changes in statutes, regulations, rules rules, requirements or policies which might necessitate changes in Custodian's responsibilities or procedures.
