Adverse Actions - Suspensions, Demotions and Terminations. Adverse actions are proposed in writing by the worker's supervisor and will be carried out upon approval of the CEO, or his or her designee. Adverse action may be taken only after a worker has received two (2) or more written warnings during a twenty-four (24) month period for the same or similar conduct or for gross misconduct on the part of the worker. In the case of gross misconduct, it is not necessary to issue a warning prior to taking an adverse action.

  • Amendments, Suspension and Termination To the extent permitted by the Plan, this Agreement may be wholly or partially amended or otherwise modified, suspended or terminated at any time or from time to time by the Board or the Committee. Except as provided in the preceding sentence, this Agreement cannot be modified, altered or amended, except by an agreement, in writing, signed by both the Partnership and the Participant.

  • Certification of Funds; Budget and Fiscal Provisions; Termination in the Event of Non-Appropriation This Agreement is subject to the budget and fiscal provisions of the City’s Charter. Charges will accrue only after prior written authorization certified by the Controller, and the amount of City’s obligation hereunder shall not at any time exceed the amount certified for the purpose and period stated in such advance authorization. Contractor’s assumption of risk of possible non-appropriation is part of the consideration for this Agreement. THIS SECTION CONTROLS AGAINST ANY AND ALL OTHER PROVISIONS OF THIS AGREEMENT.
