Common use of Agent to Act Clause in Contracts

Agent to Act. In case any one or more Events of Default shall occur and not have been waived, subject to the provisions of Article XI, the Administrative Agent with the consent of the Required Lenders, may, and at the direction of the Required Lenders shall, proceed to protect and enforce the rights or remedies of the Lenders and the Administrative Agent hereunder either by suit in equity or by action at law, or both, whether for the specific performance of any covenant, agreement or other provision contained herein or in any other Loan Document, or to enforce the payment of the Obligations or any other legal or equitable right or remedy.
