Agents; Subcontractors. The RHIO shall ensure that its agents, including any subcontractor, to whom the RHIO provides Protected Health Information agree to the restrictions and conditions that apply to the RHIO with respect to such information and implement the safeguards required by Section 2 with respect to electronic Protected Health Information. If the RHIO knows or should know of a material breach or violation by a subcontractor or agent that has created, received, maintained or transmitted such Protected Health Information, the RHIO shall take reasonable steps to cure the breach or end the violation, and if such steps are unsuccessful, it shall terminate the subcontract or relevant agreement, if feasible.
