Aggregate Liability. The aggregate liability of either: (a) Customer, its Affiliates and Participating Entities; or (b) Verizon and its Affiliates, to the others collectively for any and all Events in an Annual Period is limited to an amount equal to 12 times the Average Monthly Charges. For the purpose of this clause and calculation, where: (i) an Event gives rise to a number of separate liabilities, claims or causes of action, and/or (ii) an Event is a series of connected Events, such will be deemed to have occurred in the Annual Period in which the first Event occurred.

Aggregate Liability. The Insurer’s liability under this Policy shall not be additional to any benefit to which the Insured may be entitled under a previous policy of insurance, whether the insurer of that previous policy was the Insurer or another insurer and the Insurer’s liability under this Policy will be limited to the Permitted Credit Limit less any amount still owing for goods Shipped and/or covered under that previous policy.

Aggregate Liability. NH’s maximum aggregate liability in any twelve month period in respect of any single event or a series of events whether connection or unconnected arising out of or in connection with this Agreement whether in contract, tort (including negligence or breach of statutory duty) or otherwise, shall in no circumstances exceed the amount paid to NH by the Customer in the previous twelve months in respect of the relevant Service, or if the agreement has been in force less than twelve months, the lesser period. This Agreement does not exclude or limit NH’s liability for personal injury or death.
