Common use of Agreement Enforceable Clause in Contracts

Agreement Enforceable. This Agreement is enforceable against TCI and the KK in accordance with its terms except as such enforceability (i) is limited as to TCI to the provisions with respect to which it has executed this Agreement and (ii) may be limited by bankruptcy or other laws affecting the enforcement of creditors' rights generally or by general 5.2.1 equity principles and does not violate or create a default under any instrument or agreement binding on the KK;
