Agreements with Subcontractors. 6.1. Business Associate shall ensure that any of its subcontractors that create, receive, maintain, or transmit PHI on behalf of Business Associate, agree in writing to substantially the same restrictions and conditions concerning uses and disclosures of PHI as contained in this Agreement, including agreeing to implement reasonable and appropriate safeguards to protect any Electronic PHI that it creates, receives, maintains or transmits on behalf of Business Associate.
