ALTERNATIVE POSITION AT THE SAME SITE a. Where the Company, on account of redundancy offers an Employee employment at a lower base rate of pay, or work that is of a significantly different capacity or character and the Employee declines such offer, then the termination of employment shall be deemed to have been made by the Company, and the Employee will be entitled to the benefit of this Agreement. b. Where the Employee accepts a position within the Company at a lower base rate of pay the Company will make a “once only” payment in recognition of the reduction in the Employee’s classification rate of pay. The amount of the “once only” payment shall be calculated by the difference in weekly ordinary base rate of pay between each position multiplied by 26 weeks.

Then termination of employment will be deemed to have been made by the Company, and the employee will be entitled to the benefit of this Agreement. 6.2 Where an employee accepts an alternative position of a different character, a three (3) month trial period shall be observed to determine the suitability of the new position and the employee will not be denied the provisions of this agreement should the new position be unsuitable. 6.3 When an employee is offered a position within the company at a lower rate of pay, the employee can refuse the position and accept redundancy or retrenchment.
ALTERNATIVE POSITION AT THE SAME SITE. Where the Company transfers an employee to lower paid duties as an alternative to retrenchment, the employee shall be entitled to the same period of notice of transfer as the employee would have been entitled to if employment had been retrenched. Payment in lieu of an amount equal to the difference between the former ordinary time rate of pay and the new lower ordinary time rate of pay for the number of weeks still owing may be made at the Company’s option.

  • Check Meters Developer, at its option and expense, may install and operate, on its premises and on its side of the Point of Interconnection, one or more check meters to check Connecting Transmission Owner’s meters. Such check meters shall be for check purposes only and shall not be used for the measurement of power flows for purposes of this Agreement, except as provided in Article 7.4 below. The check meters shall be subject at all reasonable times to inspection and examination by Connecting Transmission Owner or its designee. The installation, operation and maintenance thereof shall be performed entirely by Developer in accordance with Good Utility Practice.

  • Tax Examinations Abroad 1. A Contracting Party may allow representatives of the competent authority of the other Contracting Party to enter the territory of the first-mentioned Party to interview individuals and examine records with the written consent of the persons concerned. The competent authority of the second-mentioned Party shall notify the competent authority of the first-mentioned Party of the time and place of the meeting with the individuals concerned. 2. At the request of the competent authority of one Contracting Party, the competent authority of the other Contracting Party may allow representatives of the competent authority of the first-mentioned Party to be present at the appropriate part of a tax examination in the second-mentioned Party. 3. If the request referred to in paragraph 2 is acceded to, the competent authority of the Contracting Party conducting the examination shall, as soon as possible, notify the competent authority of the other Party about the time and place of the examination, the authority or official designated to carry out the examination and the procedures and conditions required by the first-mentioned Party for the conduct of the examination. All decisions with respect to the conduct of the tax examination shall be made by the Party conducting the examination.
