Common use of Alternative Position Clause in Contracts

Alternative Position. (a) Where the employer, on account of redundancy, offers an employee employment at a lower rate of pay, or work that is of a significantly different capacity or character and the employee declines the offer, the termination of employment will be deemed to have been made by the employer, and the employee is entitled to the benefits provided by this clause. (b) Where an employee accepts an alternative position of a different character a one month trial period will be observed to determine the suitability of the new position and the employee will not be denied the provisions of this clause should the position be unsuitable.
