Common use of Amendment of Plan Clause in Contracts

Amendment of Plan. 6.1. The Plan may be amended or modified at any time by written agreement approved by the Boards of Directors of the Holding Company and the Bank (i) prior to the approval hereof by the stockholders of the Bank, in any respect, and (ii) subsequent to such approval, in any respect, provided that the Bank Commissioner shall approve of such amendment or modification.

The Plan may be amended or modified at any time by written mutual agreement approved by of the Boards of Directors of the Holding Company Bancorp and the Bank (i) prior to the its approval hereof by the stockholders of the Bank, in any respect, and (ii) subsequent to such approval, in any respect, provided that the Bank Commissioner shall approve of such amendment or modification.
