Common use of Amendments Binding on all Holders and Beneficial Owners Clause in Contracts

Amendments Binding on all Holders and Beneficial Owners. From and after the Effective Date, the amendments to the Second Amended and Restated Deposit Agreement effected hereby shall be binding on all Holders and Beneficial Owners of ADSs issued and outstanding as of the Effective Date and on all Holders and Beneficial Owners of ADSs issued after the Effective Date. Notwithstanding any other provision contained herein, in the Second Amended and Restated Deposit Agreement or in any ADR, from and after the Effective Date any reference in the Second Amended and Restated Deposit Agreement, any ADR or the form of ADR attached to the Second Amended and Restated Deposit Agreement to Holders and Beneficial Owners of Receipts, ADRs or American Depositary Receipts shall include, unless a reasonable interpretation of the context otherwise mandates, Holders and Beneficial Owners of ADSs.
