AND IN THE PRESENCE OF Clause Samples

The "AND IN THE PRESENCE OF" clause specifies that certain actions, such as the signing or execution of a document, must occur while specific individuals are physically present. Typically, this requirement applies to witnesses, notaries, or other parties whose presence is necessary to validate the act. For example, a contract may require that both parties sign in the presence of a notary to ensure authenticity. This clause's core function is to provide assurance of proper execution and to help prevent disputes about the legitimacy or voluntariness of the act.
