APPLICABILITY OF RULES. 1.1 The FIATA Model Rules for Freight Forwarding Services are incorporated, into this contract, referred to as Schenker’s standard trading terms and conditions. 1.2 The Freight Forwarder and Customer agree that these terms and conditions shall supersede any additional terms of any other contract which are in conflict with these terms and conditions, insofar as they increase the responsibility or obligations of the Freight Forwarder.

The Freight Forwarder and the Customer agree that these terms and conditions shall supersede any additional terms of any other contract which are in conflict with these terms and conditions, conditions insofar as they increase the responsibility or obligations of the Freight Forwarder. However, if the Customer and the Freight Forwarder concluded a framework agreement, the latter shall prevail to the extent of any inconsistency between these terms and conditions and the framework agreement.
