Application of Tenure. The Association agrees that the ultimate authority to grant or deny tenure is vested with the Employer. The Employer agrees that any decision to grant or deny tenure which is contrary to the Tenure Review Committee recommendations shall be immediately disclosed to both the probationer and the applicable Tenure Review Committee. It is further agreed that any and all decisions relating to the awarding or withholding of tenure, as well as the non-renewal or renewal of individual contracts including all decisions relating to the dismissal or discharge of an academic employee, shall not be subject to the grievance procedure of this Agreement.
