Common use of Application of the Act Clause in Contracts

Application of the Act. Except as expressly provided in this Agreement, the rights and liabilities of the Members shall be as provided in the Act. In the event of any inconsistency between any terms and conditions contained in this Agreement and any provisions of the Act, the terms of this Agreement shall govern and control except to the extent the applicable provision of the Act cannot be waived.
