The 'Appointment of the Supplier' clause formally designates a specific party as the supplier responsible for providing goods or services under the contract. Appointment of the Supplier. By the Supplier and the Customer entering into the Contract, the Customer appoints the Supplier and the Supplier agrees to perform Services, to deliver Deliverables and/or to provide the Assets to the Customer in accordance with the Contract.
Appointment of the Supplier. SAA hereby wishes to appoint the Supplier to supply the Hygiene Products to SAA in accordance with the terms and conditions of this Agreement and the Supplier hereby accepts such appointment on the terms and conditions set out in this Agreement and in its response to the RFB. The appointment in clause 3.1 is non-exclusive and, SAA shall be entitled, in SAA’s sole and absolute discretion and without reference to the Supplier, to accept the supply of the Hygiene Products or Hygiene Products similar to the Hygiene Products from any third parties whomsoever as SAA may determine. Where such appointment is required due to the Supplier not performing in terms of the provisions of this Agreement or materially deviates from its RFB response without the consent of SAA, such appointment shall be without prejudice to any other rights, remedies or recourse SAA may have whether in terms of this Agreement or at law. This Agreement will commence on the Commencement Date and subject to such provisions providing for its termination in certain circumstances continue for a period of 3 (three) years. Notwithstanding anything to the contrary SAA may terminate this Agreement for any reason, and without recourse or penalty at any time with 90 (ninety) days prior written notice.

Appointment of the Supplier. 4.1 Booyco hereby appoints The Supplier, and The Supplier hereby accepts such appointment, to provide the Goods, Products and Services on the terms and conditions set out in this Agreement.
4.2 Booyco hereby agrees to grant The Supplier the opportunity to provide Booyco with any new Goods, Products or Services should Booyco require same during the course of this Agreement or the associated Services Schedule / Contract Document on the following terms:
