Appropriate Safeguards. If return or destruction is not feasible, as determined by Covered Entity, Business Associate shall extend the protections of Section 3 of this Agreement to such information and limit further Use of such Protected Health Information to those purposes that make the return or destruction of such Protected Health Information infeasible (45 CFR 164.504(e)(2)(ii)(J)) to prevent Use or Disclosure of the Protected Health Information, other than as provided for in this Section, for as long as Business Associate retains the Protected Health Information.
