Approval of Plans and Specifications. The Plans and Specifications will conform to the requirements and conditions set out by applicable law or any effective restrictive covenant, and to all governmental authorities which exercise jurisdiction over the Leased Premises or the construction thereon.
Approval of Plans and Specifications. Neither review nor approval by or on behalf of Landlord of any Tenant’s plans nor any plans and specifications for any Tenant Alterations or any other work shall constitute a representation or warranty by Landlord, any of Landlord’s beneficiaries or any of their respective agents, partners or employees that such plans and specifications either (i) are complete or suitable for their intended purpose, or (ii) comply with Applicable Laws, it being expressly agreed by Tenant that neither Landlord, nor any of Landlord’s beneficiaries nor any of their respective agents, partners or employees assume any responsibility or liability whatsoever to Tenant or to any other person or entity for such completeness, suitability or compliance.
Approval of Plans and Specifications. Lessee shall have final approval of all plans and specifications before construction begins. Such approvals shall not be unreasonably withheld and shall be returned to Lessor within fifteen (15) calendar days of receipt from Lessor.

The owner agrees that all proceeds of any applicable insurance or other proceeds received by the owner or the CM as a result of such loss or damage shall be used solely for payment of the costs, expenses, and other charges of the reconstruction or repair of the PROJECT.

BTS Company shall be responsible for constructing the tower platforms, ice bridges, towers, fencing, grounding systems, power and telephone connections to a central demarcation point within the tower compound, and a concrete equipment pad as specified by site diagrams for Horizon's equipment and battery backup ("Tower Facilities"). BTS Company shall prepare and deliver to Horizon for its approval three copies of prototype, standard plans ("Plans") and construction specifications ("Specifications") for the construction of prototype Tower Facilities. The Plans and Specifications shall be delivered to Horizon at least fourteen (14) business days prior to obtaining the building permit on a Site. Within ten (10) days after receipt of the Plans and Specifications, Horizon shall either approve such Plans and Specifications or deliver to BTS Company detailed written objections thereto. Horizon shall approve the Plans and Specifications if they meet the minimum specifications set forth by Horizon in its Search Ring; provided, however, that Horizon shall not be required to approve the Plans and Specifications if BTS Company's Plans and Specifications contemplate tower height or loading in excess of what was contemplated in Horizon's Search Ring minimum specifications, and such excess would cause a material delay in BTS Company obtaining governmental approvals with respect to the applicable Site, and such delay would materially delay Horizon's anticipated installation date for its Equipment on such Site.

Except as otherwise expressly set forth in the Lease or the Workletter (if any), all work and all space plans, construction drawings, details, changes to the drawings must have the prior written approval of Landlord before any construction begins. Construction and design-build drawings for OTI-l, 2, 3, & 4 are to be approved in writing by the Management Office before drawings are submitted for permit. Overlaying of the ceiling lighting, mechanical, and fire sprinkler drawings is to be done before any work starts, to eliminate any conflict of installation between these trades.

Landlord represents that any work performed by Landlord prior to the Commencement Date shall be in compliance with all Applicable Laws.
Approval of Plans and Specifications. The Sponsor agrees to cooperate with the Engineer in the approval of all Plans and Specifications, or should they disapprove of any part of said Plans and Specifications, shall make a timely decision in order that no undue expense will be caused the Engineer because of lack of decisions. If the Engineer is caused to incur other expenses such as extra drafting, due to changes ordered by the Sponsor after completion and approval of the Plans and Specifications, the Engineer shall be equitably paid for such extra expenses and services involved.
Approval of Plans and Specifications. 7.2.1 Tenant shall not make any improvements to or upon the Premises, or any subsequent alterations or additions to the improvements, without the prior written approval of Director. Full and complete plans and specifications for all work, facilities, and improvements, and time required to complete same, shall be submitted to and receive the written approval of Director before work or construction is commenced. First-class standards of design and construction will be required in connection with all such work, facilities and improvements. All construction must conform with the plans and specifications as approved by Director and the established architectural design scheme for the Airport, and must be subject to City's Department of Public Works “Planning Guide”. 7.2.2 All improvements, equipment, and fixtures, including the plans and specifications therefor, constructed or installed by Tenant, its
7.2.3 Tenant shall obtain at its sole cost and expense all governmental reviews and approvals (including any approvals of the Director or any other City official), licenses, and permits which are, or may be, required and are necessary to install the improvements and/or alterations and to conduct the Authorized Activities, including, but not limited to, all plans and specifications approvals, site development reviews, development permits, and building permits. The costs and expenses which are payable by Tenant to secure these reviews and approvals may include City engineering and inspection fees (“E&I Fees”). A check in the amount of ten percent (10%) of the total estimated cost must be deposited with City with submission of construction plans, as a deposit amount toward payment of such E&I Fees. Any unused E&I Fees in excess of amount deposited shall be refunded to Tenant. Any amount incurred by City in excess of the deposit amount will be invoiced to and payable by Tenant in accordance with Section 5. Tenant shall comply with all conditions, restrictions or contingencies imposed upon, or attached to, the governmental approvals, licenses, and permits described herein.

Approval of Plans and Specifications. Lessee at its cost shall prepare and deliver to Lessor for its approval two (2) sets of the plans and specifications (“Tenant’s Plans”) for interior improvements to the Premises, including without limitation interior walls, plumbing, lighting, fixtures, electrical, and all other work necessary to enable Tenant to operate the Premises for the Primary Use (“Tenant’s Work”), which shall be subject to Lessor’s approval, which shall not be unreasonably withheld or conditioned. Lessor shall not be able to arbitrarily disapprove Tenant’s Plans, and shall only disapprove Tenant’s Plans if (1) the design negatively impacts the Building systems, (2) the design negatively impacts the Building structure, (3) the design is not in compliance with current building codes, or (4) the design negatively impacts the exterior appearance of the Building, or (5) the cost of removal at the end of the Lease will be excessive, unless Lessee posts sufficient security for such removal cost. Within 10 days after receipt of the Tenant Plans, Lessor shall return to Lessee one (1) set of prints of the Tenant Plans with Lessor’s modifications or its approval. If the Tenant Plans are returned to Lessee with modifications, but not bearing Lessor’s approval, the Tenant Plans shall be immediately revised by Lessee and submitted to Lessor for its approval within ten (10) days of their receipt by Lessee. Upon approval by Lessor, Lessee shall file a full and complete application for a building permit along with required fees and costs and obtain the necessary building permits. Following issuance of the building permits, Lessee shall commence construction of Tenant’s Work and diligently prosecute Tenant’s Work to completion. Lessor reserves the right to approve Lessee’s contractor and major subcontractors, but such approval shall not be unreasonably withheld or delayed. Notwithstanding Paragraph 7.4(b), Lessee need not remove any of Tenant’s Work, which Lessor expressly agrees in writing in its sole and absolute discretion need not be removed.
