Approved Program. 22.1 This clause shall apply to Teachers, Head Teacher Band 2, Adult Literacy Officers and Special Program Coordinators. 22.2 All Teachers, Head Teacher Band 2 (excluding Head Teacher Band 3), Adult Literacy Officers and Special Program Coordinators must have an Approved Program to meet TAFE NSW’s needs. Managers will, in consultation with Teachers, determine the duties related to teaching that shall be conducted as part of an Approved Program. An Approved Program developed under this sub-clause may be reviewed for genuine operational reasons on a semester basis. 22.4 In developing an Approved Program: 22.4.1 Attendance time for Teachers is to be 35 hours on average each week, of which 30 hours on average will be spent at the Teacher’s place of work as determined by TAFE NSW; 22.4.2 Teachers may complete up to 5 hours of their weekly related duties time off-site, including at home, subject to TAFE NSW business needs which may require additional on-site attendance from time to time; 22.4.3 The maximum number of teaching hours in a week will not exceed 30 hours, unless the Teacher agrees in writing to teach more than 30 hours to meet TAFE NSW business needs; 22.4.4 TAFE NSW must ensure that the amount of duties related to teaching programmed in any week is sufficient for the Teacher to deliver their hours of teaching;

22.3 21.3 Within the Approved Program, Teachers, Head Teacher Band 2Teachers, Adult Literacy Officers and Special Program Coordinators may flexibly undertake their direct teaching and the non- non-teaching components provided under sub-clause 22.2 21.2 over a period of up to twelve months. Managers will, in consultation with Teachersteachers, determine the duties related to teaching that shall be conducted as part of an Approved Program. 22.4 21.4 In developing an Approved Program, Employees are not restricted as to the number of hours they may undertake direct teaching in any week, provided that the total number of hours meets the annual totals provided in sub-clause 21.2 and that the requirements of 21.5 are met.
21.5 An Approved Program will not require an Employee to work unreasonable hours in excess of 35 hours per week. In determining what is unreasonable the following factors will be considered:
22.4.1 Attendance time for Teachers is 21.5.1 The staff member’s prior commitments outside the workplace, particularly the staff member’s family and carer responsibilities, community obligations or study arrangements;
21.5.2 Any risk to staff member health and safety;
21.5.3 The urgency of the work required to be 35 hours performed, the impact on average each week, the operational commitments of which 30 hours on average will be spent at the Teacher’s place organisation and the effect of work as determined by TAFE NSWclient services;
22.4.2 Teachers may complete up 21.5.4 Any other relevant matter.
21.6 Where a Teacher is required to 5 hours of their weekly related duties time off-site, including at home, subject to TAFE NSW business needs which may require additional on-site attendance from time to time;
22.4.3 The maximum number of teaching teach hours in a week excess of the annual direct teaching component specified in sub-clause 21.2, the provisions of Clause 28, Excess Teaching Hours will not exceed 30 hours, unless the Teacher agrees in writing to teach more than 30 hours to meet TAFE NSW business needs;
22.4.4 TAFE NSW must ensure that the amount of duties related to teaching programmed in any week is sufficient for the Teacher to deliver their hours of teaching;apply.
