Common use of Asset Ownership Clause in Contracts

Asset Ownership. The Borrower has good and marketable title to all of the properties and assets reflected on the balance sheets and financial statements contained in the SEC reports, and all such properties and assets are free and clear of mortgages, deeds of trust, pledges, liens, and all other encumbrances, except as otherwise disclosed in such SEC Reports.

The Borrower has and its Subsidiaries have good and marketable title to all of the properties and assets reflected on the balance sheets and financial statements contained in furnished to the SEC reportsBank, and all such properties and assets are free and clear of mortgages, deeds of trust, pledges, liens, and all other encumbrances, encumbrances except as otherwise disclosed in by such SEC Reportsfinancial statements.
