Common use of Assigned Space Clause in Contracts

Assigned Space. Access to Assigned Space on District Poles will be made available to Licensee with the understanding that such access will not be within the District’s Reserved Capacity. On giving Licensee at least sixty (60) calendar days prior notice, the District may reclaim such Assigned Space anytime during the period following the installation of Licensee’s Attachment in which this Agreement is effective if required for the District’s future use. The District shall give Licensee the option to remove its Attachment(s) from the affected Pole(s) or to pay for the cost of any Make-Ready Work needed to expand capacity so that Licensee can maintain its Attachment on the affected Pole(s). The allocation of the cost of any such Make-Ready Work (including the transfer, rearrangement, or relocation of third-party Attachments) shall be determined in accordance with Article 9.
