Assignment of Arbitrator. (a) When a party has requested that a grievance be submitted to arbitration and either party has requested that a hearing date be set, the parties shall assign an arbitrator from the mutually agreed upon list of arbitrators and set a date for the hearing. (b) The Union and Employer may mutually agree not to appoint nominees to the Board and, instead, have that matter heard by the assigned arbitrator as a single arbitrator. (c) The parties shall agree upon a list of arbitrators which shall be appended to this agreement (see Appendix B). An arbitrator may be removed from or added to the list by mutual agreement. (d) Depending upon availability, arbitrators shall be assigned cases on a rotating basis, or by mutual agreement. (e) The parties shall endeavour to develop and maintain a list of acceptable arbitrators which is gender balanced.
