ASSOCIATION RIGHTS AND PRIVILEGES. 3 SECTION 1. The City will provide A. Pursuant to Chapter 123, Public Laws 1974, the Board hereby agrees that every employee of the Board shall have the right to freely organize and join the Association the use of reasonable space on the 4 bulletin boards located in the assembly room, lunch room, detective bureau, locker rooms 5 and satellite station for the purpose of posting material concerning, but not limited toengaging in collective negotiations and other concerted activities for mutual aid and protection. As a duly selected body exercising governmental power under color of law of the State of New Jersey, the 7 Board undertakes and agrees that it shall not directly or indirectly discourage or deprive or coerce any employee in the enjoyment of any rights conferred by Chapter 123, Public Law 1974 or other laws of New Jersey or the Constitutions of New Jersey and the United States; that it shall not discriminate against any employee with respect to hours, wages, or any terms or conditions of employment by reason of his/her membership in the Association committee reports; (4) and its affiliates, his/her participation in any activities of the Association rulings and its affiliates, collective negotiations with the Board, or policy statements; (5) 8 Association recreational and social affairs; and (6) employee personal matters. No 9 material his/her institution of any grievance, complaint or proceeding under this agreement or otherwise with respect to any terms or conditions of employment. B. Nothing contained herein shall be posted which contains anything defamatory, scurrilous, matter 10 pertaining construed to candidacy for City of West Allis elective office deny or restrict to any employee such rights as he/she may have under New Jersey School Laws or other applicable laws and incumbents of such 11 offices, or anything reflecting in such manner upon the City or any of its employeesregulations. 12 Violation of this section The rights granted to employees hereunder shall be sufficient reason for removing the unauthorized posted 13 material by direction deemed to be in addition to those provided elsewhere. C. Whenever any employee is required to appear before the Board or any committee or member thereof concerning any matter which could adversely affect the continuation of that employee in his/her office, position or employment or the salary or any increments pertaining thereto, then he/she shall be given prior written notice of the reasons for such meeting or interview and shall be entitled to have a representative of the Association present to advise and represent him/her during such meeting or interview. The State Delegate or his alternate shall also be granted leave from duty without loss of regular straight time pay to attend any committee meetings regarding official PBA business if such meetings take place when the Delegate is scheduled to be on duty as long as there is sufficient manpower on that such time off does not cause any employee to work overtime nor necessitate the 2 payment of call-in pay as set forth in Article 7, Sections 5 through 7shift. 3 SECTION 4. D. The City and the Association shall be permitted agree to address the use of the courtroomcurrent Association office facility in City Hall. The use will be contingent upon the office being used for police activities. Any changes shall be mutually agreed upon by the City and the Association. E. The President, assembly 4 roomState Delegate shall be granted leave during duty without loss of regular straight time pay to attend monthly, training room or other suitable room as well as, special meetings of the Cape-Atlantic P.B.A. Conference when such meetings take place when such employee is scheduled to be on duty, provided the employee give at the police station to conduct business 5 meetings subject least seventy-two (72) hours notice to the approval Chief or his designated representative and as long as there is sufficient manpower (minimum required) on that shift. F. The President, State Delegate or authorized Officer of the Association shall be granted leave from duty without loss of regular straight time pay to attend Collective Bargaining Seminar or Retirement Seminars hosted by the State Association, when such officer is to be scheduled on duty, provided the PBA Representative(s) gives at least 72 hours notice to the Chief of PolicePolice or his designee. ASSOCIATION RIGHTS AND PRIVILEGES. 3 SECTION 1A. The SOA shall have the right to conduct meetings at reasonable times on municipal premises provided twenty-four hour notice is first given to the employer by requesting the permission B. The Township agrees to be bound by the provisions of N.J.S.A. l1A:6-10. C. The Association President and/or his representatives shall have the right to visit the Township Administrator or Chief of Police, police headquarters and all other police occupied facilities during off-duty hours for Association business. The City Association President or his representative shall have the right to visit other officials of the Township government for Association business and for such meetings as are necessary. D. The Township will provide the SOA with sufficient wall space for a bulletin board. This space must be easily accessible to all members. E. The Association shall be furnished with copies of all directives, general orders, special orders, personnel orders, rules, regulations and procedures which are in writing for employees covered by this contract. Said copies of the use above shall be furnished to the Association within approximately (7) calendar days of reasonable space on the 4 bulletin boards located promulgation. F. The President of the SOA and its Officers shall be entitled to up to eight (8) paid days of leave, in the assembly roomaggregate, lunch roomto attend SOA related functions or meetings at local, detective bureaustate or national locations. These functions may include seminars relating to collective negotiations or other meetings involving matters related to operation of the SOA, locker rooms 5 and satellite station for as determined by the purpose of posting material concerning, but not limited to, the 7 Association committee reports; (4) Association rulings or policy statements; (5) 8 Association recreational and social affairs; and (6) employee personal mattersSOA. No 9 material shall be posted which contains anything defamatory, scurrilous, matter 10 pertaining to candidacy for City of West Allis elective office and incumbents of such 11 offices, or anything reflecting in such manner upon the City or any of its employees. 12 Violation of this section shall be sufficient reason for removing the unauthorized posted 13 material by direction of the Chief of Police or designated representative. Any dispute as 14 to the exercise by the Chief of Police of this discretion shall be subject to the grievance 15 procedure. 16 SECTION 2. Not more than two (2) Association representatives will be granted SOA officers shall take paid time off, 17 without loss of pay, off at any one (1) time to attend labor contract negotiation meetings with 18 such meetings. ASSOCIATION RIGHTS AND PRIVILEGES. 3 SECTION 1A. The Board agrees to furnish to the Association one copy of agenda and minutes of all public meetings as duplicated and distributed to the Board members and the County Superintendent of Schools; one copy of names and addresses of all employees covered by the unit; and, in response to reasonable requests from time to time, available public information concerning the school district which the Association may require. Nothing contained herein shall impose any obligation upon the Board to disclose any information, which may be classified as privileged and/or confidential. B. Whenever any representative of the Association or any employee participates during working hours in mutually scheduled negotiations or grievance proceedings, (s)he shall suffer no loss in pay. Any representative or employee who is out of work on a medical leave, paid or unpaid, shall not participate in grievance proceedings or negotiations until (s)he returns to work. C.
