Common use of Assumed Name Clause in Contracts

Assumed Name. Tradenames and Trademarks. Pathnet shall have the right to market Excess Capacity under its name or any other assumed name, tradename or trademark which Pathnet is authorized to use for such purpose; provided, however, Pathnet shall not use any trademark or tradename of Incumbent or any Affiliate of Incumbent for any purpose, including the marketing of any excess capacity without the prior written consent of Incumbent.
