Common use of Assumption of Risk and Responsibility Clause in Contracts

Assumption of Risk and Responsibility. My participation in this activity is purely voluntary. I agree to accept and assume responsibility for all risks existing in this activity, even those risks arising out of negligence on the part of the Foundation, or other third parties. I accept and assume full responsibility for myself and all passengers on the Sailboat, including any minor children, for any and all claims including, but not limited to, bodily injury, accident, illness, paralysis, death or loss of personal property even if caused, in whole or in part, by the negligence or other fault of the Foundation, its officers, directors, employees, agents, subsidiaries, legal representatives and assigns. I agree to the foregoing because I understand that the Sailboat, water bodies and areas in and around Sailboat can be hazardous to both persons and property, thereby posing a substantial risk of damage to property and injury and even death to persons.
