Common use of Assumption of Risks Clause in Contracts

Assumption of Risks. Understanding, acknowledging and agreeing to all the risks and hazards involved with the CrossFit Event, I freely and voluntarily choose to participate in the CrossFit Event, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the CrossFit Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venue, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Event.

I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the CrossFit Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using the Venue. Assumption of Risks. UnderstandingI AM AWARE AND UNDERSTAND THAT THE ACTIVITIES INVOLVE MANY RISKS, acknowledging and agreeing to all the risks and hazards involved with the CrossFit EventDANGERS AND HAZARDS, INCLUDING BUT NOT LIMITED TO THE RISK OF SERIOUS INJURY, DEATH OR PROPERTY DAMAGE. I freely and voluntarily choose to participate in the CrossFit Event, travel to, enter and use the Venue, and ACKNOWLEDGE THAT I HEREBY AM VOLUNTARILY AND EXPRESSLY AGREE TO PARTICIPATING IN THE ACTIVITIES. I FREELY ACCEPT AND FULLY ASSUME ANY AND ALL RISK OF LOSSTHE RISKS, DAMAGESDANGERS AND HAZARDS INVOLVED AND THE POSSIBILITY OF INJURY, THEFTDEATH OR PROPERTY DAMAGE, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT, INCLUDING THE RISK I MAY BE INJURED WHETHER CAUSED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS REBELS ITK OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUEOTHERWISE. I understand hereby expressly waive and agree that by agreeing to this Agreement, I am assuming full responsibility for release any and all risk claims which I have or may in the future have against the Rebels ITK, its affiliates, and their respective partners, directors, officers, employees, agents, representatives, shareholders, successors and assigns (collectively, "Releasees"), on account of death, serious personal injury, temporary or permanent disabilitydeath, or property loss and/or damage suffered by me damage, arising out of or attributable to my property participation in connection with the CrossFit Event whether Activities, due to any cause whatsoever, including without limitation the negligence of the Rebels ITK or not described in this Agreementany other Releasee, known breach of contract, or unknown, inherent breach of any statutory or other duty of care owing under occupiers liability legislation or otherwise, or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (covenant not to make or registered domestic partner), my guardians, bring any such claim against the executors Rebels ITK or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my childrenany other Releasee, and any guardian ad litem for said children (collectively, forever release and discharge the “Releasors”)Rebels ITK and all other Releasees from liability under such claims. I accept full undertake to act reasonably and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venue, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks with care while participating in the CrossFit Event or using Activities, and acknowledge that my actions and behavior may affect myself, other releasors, Rebels ITK, and the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and Releasees participating in the CrossFit EventActivities. If I consume alcohol or other inebriating substances during the Activities I shall do so in a safe manner and at my own risk, and I undertake that if I do so I shall make arrangements to obtain safe transportation after the Activities such that I will not drive home in an inebriated or unsafe state. I shall defend, indemnify and hold harmless the Rebels ITK and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including reasonable legal fees, in connection with any third-party claim, suit, action or proceeding arising out of or resulting from my negligence or reckless behavior during the Activities.

Assumption of Risks. Understanding, acknowledging and agreeing to all the risks and hazards involved with the CrossFit Event, I freely and voluntarily choose to participate in the CrossFit LMS Event, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT OR FROM ANY PRIZES THAT MAY BE AWARDED TO ME IN CONNECTION WITH THE CROSSFIT EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS ACTIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the CrossFit LMS Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers observers, or other individuals who I have invited to the Venue, and property we have brought to the Venueproperty, and I assume the risk of damage, theft, loss loss, or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Event.

Assumption of Risks. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious death or personal injury, temporary or permanent disability, injury or property loss and/or damage suffered by me or my property in connection with the CrossFit Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). By affirmatively checking the appropriate box and agreeing to this Agreement, I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venueproperty, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Event.

Assumption of Risks. Understanding, acknowledging and agreeing to all the risks and hazards involved with the CrossFit Event2TOA AOTEAROA 2018 event, I freely and voluntarily choose to participate in the CrossFit Event2TOA AOTEAROA 2018 event, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT OR FROM ANY PRIZES THAT MAY BE AWARDED TO ME IN CONNECTION WITH THE EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS ACTIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the CrossFit Event whether or not described in this Agreement, known or unknown, inherent or otherwise, 2TOA AOTEAROA 2018 event or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner)spouse, my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venueproperty, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Event.

Understanding, acknowledging and agreeing to all the risks and hazards involved with the CrossFit ATA Event, I freely and voluntarily choose to participate in the CrossFit ATA Event, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT ATA EVENT OR FROM ANY PRIZES THAT MAY BE AWARDED TO ME IN CONNECTION WITH THE ATA EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT ATA EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the CrossFit ATA Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venue, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit ATA Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit ATA Event.

Assumption of Risks. Understanding, acknowledging and agreeing to all With my participation in the risks and hazards involved with the CrossFit Eventabove event, I freely acknowledge hereby, of my own free will and voluntarily choose to participate without inducements, promises or statements other than those contained in the CrossFit Event, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming solely responsible for any certain risks of physical injury; and I agree to assume the full responsibility risk of any nature, whatsoever for any death, any injuries, damages or loss of property, and the person and the property of others, which me / my child / my extended family may sustain as a result of attending/ volunteering/participating in any and all risk of death, serious personal injury, temporary activities connected with or permanent disabilityassociated with such a program. I for myself, or property on behalf of my child and for my heirs, representatives, assigns, successors and administrators, hereby express release and agree to waive and relinquish all claims I or my child and extended family may have as a result of my attending/ volunteering/participating at this event, against Saratoga Cares Foundation, Saratoga’s Got Talent team, Silicon Valley’s Got Talent, Silicon Valley’s Got Bollywood , Saratoga High School, ▇▇▇ Productions, Blue Rock Shoot and its officers, agents, servants and employees from any and all claims from injuries, damage or loss and/or which may have or which accrue to me or my child on account of attending/ volunteering/participating in the program. In participating in the above event, I for myself or on behalf of my child and for my heirs, representatives, assignees, successors and administrators, hereby express release and agree to state that I am performing voluntarily as an opportunity to highlight my or my child’s talent, and waive any rights for any compensation whatsoever. I also understand that food at this event is available, and the purchase or consumption of such food is based on my desire and inclination. I agree to waive and relinquish all claims I or my child and extended family may have, as a result of food issues during my attendance, participation or volunteering against Blue Rock Shoot, Saratoga Cares Foundation, Saratoga’s Got Talent team, Silicon Valley’s Got Talent, Silicon Valley’s Got Bollywood, Saratoga High School, ▇▇▇ Productions, Blue Rock Shoot and its officers, agents, servants and employees from any and all claims from injuries, damage suffered or loss which may have or which accrue to me or my child on account of participation in the program. I further agree to indemnify and hold harmless and defend Saratoga Cares Foundation, Saratoga’s Got Talent” team, Silicon Valley’s Got Talent, Silicon Valley’s Got Bollywood , Saratoga High School, ▇▇▇ Productions, Blue Rock Shoot and its officers, agents, servants and employees from any and all claims sustained by me or my property child, arising out of, connected with, or in connection any way associated with the CrossFit Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using activities of the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venue, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Eventprogram.

Assumption of Risks. UnderstandingRisks encountered by Visitors, acknowledging climbing or simply moving about activity areas and agreeing to the premises (including walkways, parking areas and lawn), may result in all manner of trauma including breaks, sprains, abrasions, serious injury and emotional upset and even death. I hereby acknowledge the risks described above and their inherency, and acknowledge that other risks, inherent and otherwise, may be encountered. I expressly assume all the risks of the Gym and hazards involved with the CrossFit Eventits activities, I freely indoors and voluntarily choose to participate in the CrossFit Eventout, travel to, enter and use the Venueinherent or not, and whether or not described above. If I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreementam the Parent of a minor visitor, I am assuming full responsibility fully informed of the nature of the activities and risks, I understand them and have discussed them with the minor child, who understands and accepts them. Release and Indemnity: I, an adult Visitor or Parent (Parent, for myself and, to the extent allowed by the laws of the State of Colorado, on behalf of the minor Visitor), agree to release and not to sue ABC For Kids, LLC, ABC For Kids II, LLC, and their respective owners, managers, members, officers and staff (“Released Parties”) with respect to any and all risk claims of injury, disability, death, serious personal injury, temporary products liability (including strict liability) or permanent disability, other loss or damage to person or property loss and/or damage suffered by me or by the minor Visitor, arising in whole or part from my property in connection with (or the CrossFit Event whether minor Visitor’s) visit to the Gym or not described in this Agreementoutdoor climbing sites, known including transportation to and from those sites. In addition, I agree to indemnify (that is, defend and satisfy by payment or unknownreimbursement, inherent including costs and attorney’s fees) Released Parties from any and all claims of injury, disability, death, products liability (including strict liability) or otherwiseother loss or damage to person or property, brought by me or by or on behalf of the minor Visitor, another Visitor to the Gym or other activity site, a member of my, or while visitingthe minor Visitor’s, traveling family, or anyone else, arising out of or in any way related to a loss suffered by me or using the Venue. I understand and agree that this Agreement will be binding on meminor Visitor, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venue, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for me or the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Eventminor Visitor.

Assumption of Risks. Understanding, acknowledging and agreeing to all the risks and hazards involved with the CrossFit Event, I freely and voluntarily choose to participate in the CrossFit Event, travel to, enter and use the Venue, and I HEREBY VOLUNTARILY AND EXPRESSLY AGREE TO ACCEPT AND ASSUME ALL RISK OF LOSS, DAMAGES, THEFT, INJURY OR DEATH THAT MAY OCCUR TO ME OR MY PROPERTY AS A RESULT OF OR INCIDENT TO MY PARTICIPATION IN THE CROSSFIT EVENT OR FROM ANY PRIZES THAT MAY BE AWARDED TO ME IN CONNECTION WITH THE CROSSFIT EVENT, INCLUDING THE RISK I MAY BE INJURED BY THE ACTIONS, OMISSIONS, REPRESENTATIONS ACTIONS OR NEGLIGENCE OF THE RELEASED PARTIES, OTHER PARTICIPANTS OR THIRD PARTIES WHILE PARTICIPATING IN THE CROSSFIT EVENT OR VISITING, TRAVELING TO OR FROM OR USING OR VISITING THE VENUE. I understand and agree that by agreeing to this Agreement, I am assuming full responsibility for any and all risk of death, serious personal injury, temporary or permanent disability, or property loss and/or damage suffered by me or my property in connection with the CrossFit Event whether or not described in this Agreement, known or unknown, inherent or otherwise, or while visiting, traveling to or using the Venue. I understand and agree that this Agreement will be binding on me, my spouse (or registered domestic partner), my guardians, the executors or administrators of my estate, my heirs, my personal representatives, my assigns, my successors in interest, my children, and any guardian ad litem for said children (collectively, the “Releasors”). I accept full and complete responsibility for the safety of myself, any guests, observers or other individuals who I have invited to the Venue, and property we have brought to the Venueproperty, and I assume the risk of damage, theft, loss or injury caused by others to me, my guests and our property. I also accept full and complete responsibility for the consequences of taking unreasonable risks while participating in the CrossFit Event or using the Venue, including, without limitation, attempting activities that I am not qualified to perform safely, causing any other participants/spectators an unreasonable risk of harm, or failing to follow correct safety procedures when using the Venue and participating in the CrossFit Event.

Assumption of Risks.
