Authority to Construct. Subject to the provisions of Section 3 herein, the District hereby authorizes the City to proceed with construction of the work for the purpose intended by this Agreement, and as further described in Section 8.
Authority to Construct. Applicant shall construct the onsite electrical facilities necessary to service residential land uses pursuant to the electrical engineering plans provided by the City. City shall have the right to obtain competitive bids from competent and qualified contractors for the installation of the onsite electrical system necessary to service commercial and industrial land uses as well as all offsite improvements in compliance with the plans prepared by the City. Lowest bids of qualified contractors shall be accepted and utilized in constructing said portions of the electrical system. Upon activation of such facilities for use, such facilities shall be conveyed to, owned and maintained by the City.
Authority to Construct. Owner shall obtain an authority to construct from the DISTRICT for the EVR Phase II Upgrade prior to commencing the upgrade work.

The City shall construct all offsite electrical facilities necessary to serve the Property. The City and Developer shall have the right to obtain competitive bids from competent and qualified contractors for the installation of the electrical system to and through the Property in compliance with the plans therefore prepared by the City. The lowest bids of qualified contractors shall be accepted and utilized in constructing said electrical system provided such bids and the contract entered pursuant thereto shall comply with the standards set forth in Exhibit H attached hereto (“Electric Contract Bid Standards”). Upon activation of such facilities for use, such facilities shall be conveyed to, owned and maintained by the City in accordance with the terms and provisions of the Agreement. If the existing offsite electrical system requires upgrades to serve the Property, Developer and the City shall share the expense per City Code.

  • Authority to Contract Each Party represents and warrants that it has full right, power and authority to enter into and perform its obligations under this Agreement, and that the person signing this Agreement is duly authorized to enter into this Agreement on its behalf.

  • Laws Applicable to Construction The interpretation, performance and enforcement of this Agreement shall be governed by the laws of the State of Delaware as applied to contracts executed in and performed wholly within the State of Delaware, without reference to principles of conflict of laws.

  • No Construction Against Drafting Party The parties and their respective counsel have had the opportunity to review the Agreement, and the Agreement will not be construed against any party merely because any provisions of the Agreement were prepared by a particular party.
