Common use of Authorizing Ordinance Clause in Contracts

Authorizing Ordinance. As an essential condition precedent to the validity of this Agreement, Grant County has already enacted an ordinance to authorize, approve and establish an E-911 system. To the extent that that said ordinance has a termination date, Grant County shall re-enact the said ordinance or enact a new ordinance to provide for the continued maintenance and operation of the said PSAP. The previous ordinance authorized collection of a surcharge from each subscriber by the local telephone company and the payment of the funds from said surcharge into a special trust account for payment of expenses for the E-911 system authorized by the said ordinance and any re- enactment or new authorizing ordinance may provide for the same type of surcharge. The previous ordinance and any re-enactment of an ordinance for the maintenance and operation of the PSAP shall comply with applicable Kentucky Revised Statutes and shall be in a form acceptable to the local telephone company. To the extent that any of the said city ordinances has a termination date, each said city shall re-enact their city ordinance or enact a new ordinance to provide for the continued maintenance and operation of the said PSAP. Authorizing Ordinance. As The passage of an essential condition precedent authorizing ordinance authorizing City’s sale of the Sale Property to Skanska on the terms described in this Agreement (the “Authorizing Ordinance”) by the Seattle City Council (“City Council”) and such Authorizing Ordinance becoming effective law are conditions to City’s obligation to sell the Sale Property to Skanska. No later than September 25, 2017, City shall submit to the validity Mayor of The City of Seattle for his transmittal to City Council the proposed Authorizing Ordinance with contemporaneous notice to Skanska of such submittal. ▇▇▇▇▇▇▇ acknowledges that approval of the Authorizing Ordinance is made at the discretion of a majority of the members of the City Council and failure of the Authorizing Ordinance to be passed by the City Council and subsequently to become effective shall not constitute a default by City under this Agreement.
