Availability of Services. 1. In addition to the availability of services requirements set forth in Article II.E.1 of this Agreement, the Contractor shall: i. Consider the number and types (in terms of training, experience, and specialization) of providers required to ensure the availability and accessibility of medically necessary services. ii. Maintain and monitor a network of appropriate providers that is supported by written agreements for subcontractors, and that is sufficient to provide its beneficiaries with adequate access to all services covered under this Agreement. iii. In establishing and monitoring the network, document the following: a. The anticipated number of Medi-Cal eligible beneficiaries. b. The expected utilization of services, taking into account the characteristics and SUD treatment needs of beneficiaries. c. The expected number and types of providers in terms of training and experience needed to meet expected utilization. d. The number of network providers who are not accepting new beneficiaries. e. The geographic location of providers and their accessibility to beneficiaries, considering distance, travel time, means of transportation ordinarily used by Medi-Cal beneficiaries, and physical access for disabled beneficiaries.

Availability of Services. CBT agrees not to discontinue or refuse to provide any service provided or required hereunder other than in accordance with the terms of this Agreement, or unless required by the Commission.

Availability of Services. If Verizon cannot fulfill an Order (after the Commencement Date) for reasons other than Force Majeure Event, after making commercially reasonable efforts to fulfill such Order, Verizon will notify Customer as soon as possible and where available, Verizon will advise Customer of any alternative Service offerings. In any event Verizon will have no further obligation to provide the Service under that Order.

We do not represent that LATOKEN website will be available 100% of the time to meet your needs. We will strive to provide you with the Service as soon as possible, but there is no guarantee that access will not be interrupted, or that there will be no delays, failures, errors, omissions or a loss of transmitted information. d. We will use reasonable endeavors to ensure that the Site can be accessed by you in accordance with these Terms of Use. However, we may suspend use of the Site for maintenance and will make reasonable efforts to give you notice of this. You acknowledge that this may not be possible in an emergency, and accept the risks associated with the fact that you may not always be able to use the Site or carry out urgent transactions using your Wallet. e. We may restrict or terminate access to our services for violation of LATOKEN rules and conditions, as specified in details in section 14, SUSPENSION, CLOSURE, AND TERMINATION

Availability of Services. While we try to complete service as quickly as possible, we are not responsible for delays caused by factors beyond our control, including but not limited to manufacturer delays, parts availability, shipping to a regional service facility, Acts of God or other external causes.

Availability of Services. League InfoSight shall use commercially reasonable efforts to provide access to its Application Services twenty-four (24) hours a day, seven (7) days a week throughout the term of this Agreement. You agree that from time to time the Service may be inaccessible or inoperable for various reasons, including scheduled maintenance procedures or upgrades or certain unscheduled Service or equipment malfunctions that are beyond the control of League InfoSight such as interruption or failure of telecommunication or digital transmission links, hostile network attacks or network congestion or other failures.

Availability of Services. Appointment of the Service Provider to this Framework Agreement shall entitle the Service Provider to payment for making available Relevant DS3 System Services, as set out in Schedule 9 Part 3, in accordance with the terms, conditions and specifications of this Agreement where the following conditions exist: a) Where the Providing Unit can provide Relevant DS3 Services in accordance with Schedules 2, and/or Schedule 3 and/or Schedule 4, and; b) Where the Service Provider provides availability to the Company of the Relevant DS3 System Services.

Availability of Services. You accept that the availability of electronic services will depend, among other factors, on the availability and continuous operation of the computerized system and the communications processing line of the Cooperative, your Internet service provider, your browser, your personal equipment, your access equipment and telephone or electrical lines. In case of any interruption, the Cooperative will not assume legal responsibility for it.

The ACO shall not, and shall require its Participant Providers and Preferred Providers to not, take any action to avoid treating At-Risk Beneficiaries or to target certain Beneficiaries for services for the purpose of trying to affect the population of Beneficiaries aligned to the ACO for a subsequent Performance Year.
