Award to the Settlement Class Clause Samples
The 'Award to the Settlement Class' clause defines the process and terms under which compensation or benefits are distributed to members of a settlement class in a legal agreement, typically following a class action lawsuit. Award to the Settlement Class. Each Authorized Claimant is entitled to a Settlement Payment. To be entitled to receive a Settlement Payment, a Class Member must timely submit a valid and complete Claim Form. The manner for submitting a timely, valid, and complete Claim Form is specified below in Section 3.6. A Class Member who submits an untimely, incomplete or invalid Claim Form is not entitled to receive a Settlement Payment.
Award to the Settlement Class. All Identifiable Class Members, during the period of February 28, 2002 through February 28, 2006, who do not opt out of the settlement, shall automatically be entitled to receive $10 pursuant to Sections 3.2 through 3.8 of this Agreement. Further, Non-Identifiable Class Members who submit a valid and timely Claim Form will be entitled to receive $10 pursuant to Sections 3.2 though 3.8 of this Agreement.
Award to the Settlement Class. Kipling, through the Claims Administrator, shall
(a) to each Claim-in-Settlement-Class Member, one (1) Voucher; and
(b) to each Direct Benefit Settlement Class Member one (1) Direct Benefit Voucher.
Award to the Settlement Class. For each Settlement Class Member who submits a timely, completed, and valid Claim Form that includes evidence that the Settlement Class Member’s Idol 3 Smartphone used the T-Mobile Network (including Idol 3 Smartphones using mobile virtual network operators (“MVNOs”)), Defendants, at Defendants’ sole and exclusive option, shall either: (1) reinstate LTE Band 12 functionality on the particular Settlement Class Member’s Idol 3 Smartphone within a reasonable period of time not to exceed three (3) months from Final Judicial Approval (the “Award Deadline”) (or within one (1) month of the receipt of a valid and timely Claim Form if the Claim Form is received after the Award Deadline); or (2) provide a comparable replacement Alcatel smartphone (i.e., one with a non-discounted manufacturer’s suggested retail price of at least $179.99 and LTE Band 12 compatibility) for each Idol 3 Smartphone originally purchased by that Settlement Class Member within a reasonable period of time not to exceed three (3) months from Final Judicial Approval (or within one (1) month of the receipt of a valid and timely Claim Form if the Claim Form is received after the Award Deadline).
Award to the Settlement Class. Within thirty (30) days of the Effective Date, Michaels will cause the Administrator to send the Notice of Settlement Payment Cash-Value Certificate, which will instruct each Settlement Class Member how to obtain a Settlement Payment consisting of one $32.50 Michaels cash-value certificate (substantially in the form appended as Exhibit C-1), on terms and conditions set forth herein. There shall only be one Settlement Payment available per Settlement Class Member. The Settlement Payment will not be replaced if lost or stolen. At the time the Settlement Payment is issued by the Administrator either by download or by mail, each Settlement Class Member will have the opportunity to request that the cash-value certificate be made out in the name of any individual that he/she chooses. Settlement Class Members who fail to utilize their Settlement Payment in a timely fashion shall, like all Settlement Class Members, remain subject to the terms of the Judgment.
Award to the Settlement Class. Each Authorized Claimant is entitled to receive a Settlement Payment. To be entitled to receive a Settlement Payment, a Class Member must timely submit a valid and complete Claim Form and any supporting documentation required. The manner for submitting a timely, valid, and complete Claim Form is specified in Section 3.6 below. Payments shall be made by check to the Authorized Claimants. Authorized Claimants who receive a check shall have one hundred eighty (180) calendar days from the date of issuance within which to negotiate the check. Any checks not negotiated within the one hundred eighty (180) day-period shall be cancelled, and the funds for any such Authorized Claimant’s Settlement Payment shall be returned to Cardinal Financial.
Award to the Settlement Class. All Settlement Class Members will automatically receive either by email or U.S. Mail a Voucher to be used at any Eligible Voucher Redemption Store.
